Eight important rulings
**Conditions and Rulings:** **1. Legal Capacity Required:** Both agent and principal must be legally capable of disposal: adult, sane, and prudent. **2. Valid for Deputizable Matters:** Agency is valid in anything that accepts deputization: sales, purchases, all contracts, terminations like divorce and khul'. **3. Valid for Deputizable Worship:** Also valid in worship that accepts deputization: giving zakah, kaffara, vows, Hajj, and similar. **4. Invalid for Non-Deputizable Worship:** Agency is not valid in worship that doesn't accept deputization from Allah's rights, like purification and prayer. **5. Agent's Authority:** The agent has disposal authority as permitted by the principal or as customarily understood, provided no harm results to the principal. **6. No Sub-Delegation Without Permission:** The agent may not appoint another agent unless the principal permits it, or the agent is unable to work, or it is beneath him - then he may appoint a trustworthy person to act on his behalf. **7. Agent is a Trustee:** The agent is a trustee in what he is authorized for; he is not liable except for negligence or transgression. **8. Terminable Contract:** Agency is a permissible (non-binding) contract; either party may terminate it. **9. Voiding of Agency:** Agency is voided by death of either party, insanity, termination by either, dismissal by the principal, or interdiction.
