Whoever swears, let him swear by Allah or be silent
Valid and invalid forms of swearing
**Permissible Oaths:** Oaths are only valid when sworn by Allah, His names, or His attributes. **Examples:** - "By Allah" (والله) - "By the Face of Allah" (ووجه الله) - "By His Greatness and Majesty" (وعظمته وكبريائه) **Evidence:** The Prophet ﷺ caught up with Umar ibn al-Khattab while he was swearing by his father. He said: "Indeed Allah forbids you to swear by your fathers. **Whoever swears, let him swear by Allah or be silent**" [Bukhari & Muslim]. Ibn Umar said: "The Prophet's oath was: 'No, by the Turner of hearts'" [Bukhari]. Also: "I swear by Allah to do such..." is an oath if intended. --- **Prohibited Oaths:** **1. Swearing by other than Allah:** Such as "by your life," "by the trust (amānah)," etc. **Evidence:** "Whoever swears, let him swear by Allah or be silent" [Agreed upon]. --- **2. Swearing by Judaism/Christianity or disavowal from Allah:** Like saying: "I am a Jew/Christian" or "I am free from Allah or His Messenger" if I do such - then doing it. **Evidence:** The Prophet ﷺ said: "Whoever swears saying 'I am free from Islam' - if he is lying, he is as he said; and if he is truthful, he will not return to Islam safely" [Abu Dawud - authentic]. --- **3. Swearing by ancestors or Taghut:** **Evidence:** The Prophet ﷺ said: "Do not swear by the Tawaghit (false deities), nor by your fathers" [Muslim].
