Property acquired without battle
**Definition:** Fay': Property taken from the people of war rightfully without fighting - like property that disbelievers abandon and flee from when they hear of the Muslims' approach. **Distribution:** - Used for the general interests of Muslims as the Imam sees fit - Salaries of judges, muezzins, imams, scholars, teachers, etc. - Other Muslim public interests **Evidence:** - **Hadith of Umar رضي الله عنه:** "The property of Banu Nadir was among what Allah gave as fay' to His Messenger ﷺ without the Muslims having to exert upon it with horses or camels. It was for the Messenger of Allah ﷺ exclusively. He would spend on his family for a year, then put what remained in weapons and mounts as equipment in the path of Allah" [Bukhari & Muslim] **Quran:** - **Quran:** "What Allah has restored to His Messenger from the people of the towns - it is for Allah and for the Messenger and for [his] near relatives and orphans and the [stranded] traveler - so that it will not be a perpetual distribution among the rich from among you" [59:7] The Imam takes from it without restriction and gives to relatives by his judgment, spending the rest on Muslim interests.
