When Hadd Drops

The hadd of hirabah **drops** if the criminal repents **before** being captured. **Evidence:** Allah says: "Except those who repent **before you have power over them**. Know that Allah is Forgiving, Merciful" [Al-Ma'idah: 34]. **What Drops:** - Exile from the land - Cutting of hand and foot - Mandatory execution These are Allah's rights, so they are dropped by repentance before capture. --- **What Does NOT Drop:** - Rights of people (huqūq al-ādamiyyīn): - Lives (qisas for killing) - Limbs - Property These do not drop because they are personal rights, like debts, unless the victims pardon. --- **After Capture:** If the person repents **after** being captured and brought to the authorities, the hadd is **not dropped** - even if his repentance is sincere.
