Six important rulings
**Rulings of Pledge:** **1. What Cannot Be Pledged:** - What cannot be sold (like waqf, dogs) cannot be pledged - debt cannot be recovered from it - One cannot pledge what he doesn't own **2. Knowledge Required:** The amount, type, and description of the pledge must be known. **3. Pledgor's Qualifications:** The pledgor must be legally capable of disposal, owning the pledged item or authorized to pledge it. **4. Disposal Restrictions:** - The pledgor cannot dispose of the pledge without the pledgee's consent - The pledgee cannot dispose of it without the pledgor's consent **5. Pledgee's Use of Pledge:** The pledgee may not benefit from the pledge, except if it is rideable or milkable - then he may ride or milk it if he spends on it. **6. Pledge as Trust:** The pledged item is a trust in the pledgee's hand; he is not liable except for transgression. When the debt becomes due: - The debtor must pay - If he refuses, the judge compels him - If he still refuses, he is imprisoned and disciplined until he pays - Or the pledge is sold and the debt paid from its value
