**1. The Compelled Person:** One who speaks words of kufr due to compulsion is not judged as an apostate. **Evidence:** Allah says: "Except one who is compelled while his heart is secure in faith" [An-Nahl: 106]. --- **2. Repentance Period:** The apostate is asked to repent for three days - if he repents, [he is released]; otherwise he is executed. The execution is carried out by the Imam or his deputy, as previously mentioned. --- **3. Property:** The apostate is prevented from disposing of his property. - If he returns to Islam, he regains control of it - If he dies or is executed as an apostate, his property becomes **fay'** (state property) for the Muslim treasury This is because he has no heir - Muslims don't inherit from disbelievers, and disbelievers cannot inherit from him since apostasy cannot be approved. --- **4. Funeral Rites:** The apostate who dies upon apostasy: - Is not washed (ghusl) - Is not prayed upon (janazah) - Is not buried with Muslims --- **5. How to Repent:** Repentance is achieved by pronouncing the two testimonies (shahādatayn). **General Evidence:** The Prophet ﷺ said: "I have been commanded to fight people until they testify that there is no god but Allah..." [Bukhari & Muslim]. **Specific Cases:** If the apostasy was due to denying something from the religion, then besides pronouncing the shahādatayn: - He must affirm what he denied - And retract what he disbelieved in
