Proofs of legislation and purpose
**Evidence for Diyah:** Diyah is obligatory by the Quran, Sunnah, and Consensus. **1. From the Quran:** Allah says: "And whoever kills a believer by mistake - then the freeing of a believing slave and a compensation payment (Diyah) presented to the deceased's family" [An-Nisa: 92]. **2. From the Sunnah:** Abu Hurayrah رضي الله عنه reported that the Prophet ﷺ said: "Whoever has someone killed has the choice of two things: either to receive blood money (Fidyah) or to have retaliation" [Bukhari & Muslim]. Also, the hadith of 'Amr ibn Hazm in the letter the Prophet ﷺ wrote to him containing the amounts of Diyah. **3. Consensus:** The scholars have unanimously agreed on the obligation of Diyah. --- **Wisdom of Diyah:** - Preservation of lives - Protection of innocent blood - Deterrence and restraint from disregarding human life
