Forms of payment and their quantities
**A. Forms of Diyah:** **The original form is camels:** The Prophet ﷺ said: "In the believing soul, one hundred camels" [Nasa'i - authentic]. And he ﷺ said: "Indeed, the blood money for quasi-intentional killing - by whip and stick - is one hundred camels" [Nasa'i - authentic]. **Alternative Forms (by Valuation):** From 'Amr ibn Shu'ayb from his father from his grandfather: "The value of Diyah in the time of the Messenger of Allah ﷺ was eight hundred dinars or eight thousand dirhams... When 'Umar became Caliph, he stood as a speaker and said: 'The camels have become expensive.' So 'Umar assessed: - For gold owners: 1,000 dinars - For silver owners: 12,000 dirhams - For cattle owners: 200 cattle - For sheep owners: 2,000 sheep - For cloth owners: 200 suits" [Abu Dawud - hasan]. 'Umar رضي الله عنه did this in the presence of the Companions, and none objected - making it like consensus. **Principle:** The Diyah is paid in camels OR their value in the above items. --- **B. Amounts of Diyah:** **1. Free Muslim Male:** 100 camels. Aggravated in intentional and quasi-intentional killing - meaning 40 of them must be pregnant females (خُلفة). **2. Free Kitabi (Jewish/Christian) Male:** Half the Diyah of a Muslim - whether dhimmi or otherwise. **Evidence:** The Prophet ﷺ said: "The blood money of the people of dhimmah is half the blood money of Muslims" [Nasa'i, Tirmidhi - hasan]. **3. Muslim Woman:** Half the Diyah of a free Muslim man. **Evidence:** The letter of 'Amr ibn Hazm: "The Diyah of a woman is half the Diyah of a man." Ibn 'Abd al-Barr and Ibn al-Mundhir reported consensus on this. **4. Magian (Majusi) Male:** 800 dirhams - whether dhimmi, treaty-holder, or otherwise. Same for idol-worshippers. **Evidence:** Hadith of 'Uqbah ibn 'Amir attributed to the Prophet: "The Diyah of a Magian is eight hundred dirhams" [Bayhaqi]. **5. Magian Woman and Non-Muslim Women:** Half the Diyah of their men - as Muslim women's Diyah is half of Muslim men's. **Evidence:** General hadith of 'Amr ibn Shu'ayb: "The blood money of the People of the Book is half the blood money of Muslims." **6. Fetus:** If a fetus dies due to an assault on its mother (intentional or accidental): a Ghurrah - male or female slave. **Evidence:** Abu Hurayrah رضي الله عنه reported: "The Messenger of Allah ﷺ ruled regarding the fetus... a Ghurrah: male or female slave" [Bukhari & Muslim]. The Diyah is valued at one-tenth of the mother's Diyah = 5 camels. The Ghurrah is inherited from the fetus as if he were born alive.
