Nine rulings on endowment
**Nine Rulings:** **1. Legal Capacity:** The endower must be legally capable of disposal - sane, adult, free, prudent. **2. Known Property:** The endowed property must be known, and the endower must specify it. **3. Righteous Purpose:** The endowment must be for righteousness and good - like mosques, the poor, books of knowledge, etc. Because it is nearness to Allah. Endowing for temples of disbelievers or to purchase forbidden items is **prohibited**. **4. Disabled Endowment:** If the benefits of the endowment cease and it cannot be used, it is sold and its price is spent on similar purposes. If it was a mosque, its price goes to another mosque. If it was a house, it is sold and another house bought with its price - because this is closest to the endower's intent. **5. Binding Contract:** Waqf is a **binding contract** that is established by mere words. It may not be revoked or sold. **6. Specified Property:** The endowed property must be specified - unspecified endowment is invalid. **7. Immediate Execution:** The endowment must be immediate (not suspended or temporary), except if conditioned upon death. **8. Honoring Conditions:** The endower's conditions must be followed, provided they do not contradict Sharia. **9. Equality Among Children:** If one endows to his children, males and females receive equal shares.
