Seven conditions for valid lease
**Seven Conditions for Valid Ijarah:** **1. Legal Capacity:** Valid only from one legally capable of disposal - sane, adult, free, prudent. **2. Known Benefit:** The benefit must be known because it is the subject of the contract. Knowledge is required as in sale. **3. Known Compensation:** The rent/wage must be known because it is a payment in a commutative contract. Knowledge is required as with price in sale. **4. Permissible Benefit:** The benefit must be permissible. Hiring for fornication, singing, or selling musical instruments is not valid. **5. Capable of Delivery:** The benefit must be capable of being delivered. Hiring something from which benefit cannot be extracted is not valid - like hiring a blind person to guard something requiring sight. **6. Ownership or Permission:** The benefit must be owned by the lessor or permitted to him. Because lease is sale of benefits, ownership is required as in sale. **7. Known Duration:** The period must be known. Lease for an unknown period is not permitted because it leads to disputes.
