Rights differ based on pregnancy status
**Irrevocable Divorce Iddah:** There are two scenarios: --- **1. If She is Pregnant:** The following rights are established for her: - **Obligatory Housing:** Based on Allah's saying: "O Prophet, when you divorce women, divorce them for their waiting period... Do not turn them out of their houses, nor should they leave unless they commit a clear immorality" [At-Talaq: 1] - **Obligatory Maintenance:** Based on Allah's saying: "And if they are pregnant, then spend on them until they give birth" [At-Talaq: 6] - **Must Stay in the House:** She must remain in the dwelling where she is observing her waiting period, and not leave except for need. **Evidence for permissible exit:** Jabir رضي الله عنه reported: My aunt was divorced, and she wanted to collect (the harvest of) her palm trees. A man rebuked her for going out. So she came to the Prophet ﷺ and he said: "Yes, go and collect your palm trees, for perhaps you will give charity or do a good deed" [Muslim]. --- **2. If She is Not Pregnant:** She is entitled to what the pregnant woman is entitled to **except maintenance** and what follows it like clothing. **Evidence:** Fatimah bint Qays رضي الله عنها reported that when her husband divorced her with the third divorce, the Prophet ﷺ said to her: "There is no maintenance for you unless you are pregnant" [Abu Dawud, Nasa'i, authenticated by Al-Albani].
