Five related rulings
**Related Rulings:** **1. Worker's Duties:** The worker must do everything that leads to the betterment of the fruit - plowing, watering, cleaning, maintenance, pollinating palm trees, drying fruit, etc. **2. Land Owner's Duties:** The land owner must work on everything that preserves the origin - digging wells, providing water, erecting walls and barriers, bringing equipment and water pumps. **3. Ownership of Share:** The worker owns his share when the fruit appears. **4. Termination:** Either party may terminate the contract whenever he wishes - since they are permissible (non-binding) contracts. If terminated after fruit appears, it is between them according to their agreement. If the worker terminates before the crops sprout or fruit appears, he gets nothing - he consented to forfeit his right like a mudarabah worker. But if the capital owner terminates before fruit appears but after work has begun, the worker is entitled to wages for his work. **5. No Fruit:** If he gives him musaqah or muzara'ah for a period in which fruit normally appears, but that year there is no fruit, the worker gets nothing.
