Seven important rulings on gifts
**Seven Rulings:** **1. Binding After Receipt:** The gift becomes binding once the recipient takes possession with the giver's permission. The giver may not take it back. - **Evidence:** The Prophet ﷺ said: "The one who takes back his gift is like a dog that vomits then returns to its vomit" [Bukhari & Muslim] - **Exception:** A **father** may take back what he gave his child. - **Evidence:** The Prophet ﷺ said: "It is not lawful for a man to give a gift then take it back, except a parent regarding what he gives his child" [Abu Dawud, Tirmidhi - sahih] **2. Equality Among Children:** A father must treat his children equally in gifts. If he favors some without the others' consent, it is invalid. If they consent, it is valid. - **Evidence:** Al-Nu'man ibn Bashir's father gave him some property. The Prophet ﷺ asked: "Have you given the same to all your children?" He said no. The Prophet ﷺ said: "Fear Allah and be just with your children." In another narration: "Do not make me witness to injustice." **3. Fatal Illness:** If a father favors some children during his terminal illness, it is invalid unless the remaining heirs approve after death. **4. Conditional Gifts Valid:** Conditional gifts are valid - like saying: "If the traveler arrives" or "If rain falls, I give you such." **5. Debt Forgiveness:** Gifting a debt to the debtor is valid and counts as releasing him from the debt. **6. Accepting Small Gifts:** One should not refuse gifts - even if small - and it is Sunnah to reciprocate, following the Prophet's practice. **7. Do Not Harm Heirs:** It is **prohibited** if the giver intends to harm his heirs. - **Evidence:** Allah says: "without causing harm" [Surah An-Nisa: 12]
