Establishing one hadd is better than forty nights of rain
Obligation, intercession, who implements, and where
**A. Obligation to Establish Hudud:** Hudud MUST be established among the people to prevent sins and deter sinners. **Evidence:** The Messenger of Allah ﷺ said, encouraging the establishment of Hudud: "Establishing one of Allah's Hudud is better than forty nights of rain in Allah's lands" [Ibn Majah - hasan]. --- **B. Prohibition of Intercession:** Intercession to drop Hudud and prevent their establishment is **forbidden** once they reach the Imam (ruler) and are confirmed before him. It is also **forbidden** for the ruler to accept intercession in this matter. **Evidence:** 1. The Prophet ﷺ said: "Whoever's intercession prevents a hadd from Allah's Hudud has opposed Allah in His command" [Abu Dawud - authentic]. 2. The Prophet ﷺ rejected Usama ibn Zayd's intercession for the Makhzumi woman who stole, and became angry. He ﷺ said: "By Allah, if Fatimah bint Muhammad stole, Muhammad would cut off her hand" [Bukhari & Muslim]. --- **C. Pardon Before Reaching the Imam:** However, pardoning the hadd **before** it reaches the Imam is permissible. **Evidence:** The Prophet ﷺ said to the man whose cloak was stolen, when he wanted to pardon the thief: "Why not before you brought him to me?" [Abu Dawud - authentic]. --- **D. Who Implements Hudud:** The one who establishes the hadd is the **Imam or his deputy**. The Prophet ﷺ used to establish Hudud in his lifetime, then his successors after him. The Prophet ﷺ also delegated others to establish the hadd on his behalf, saying: "Go, O Unays, to this man's wife. If she confesses, then stone her" [Bukhari & Muslim]. This was obligated upon the Imam to guarantee justice and prevent oppression and injustice. --- **E. Location of Implementation:** The hadd is established in **any place except the mosque**. **Evidence:** "The Prophet ﷺ forbade retaliation in the mosque, reciting poetry in it, and establishing Hudud in it" [Abu Dawud - hasan]. This is to protect the mosque from contamination and the like. In some narrations of the story of stoning Ma'iz: "He was taken out to al-Harrah and stoned" [Tirmidhi - hasan sahih].
