Ability (Istita'ah)

**Evidence:** - **Quran:** "And to Allah from the people is a pilgrimage to the House - for whoever is able to find a way" [3:97] **Types of Inability:** **1. Financial Inability:** - Does not have provisions sufficient for himself and dependents - Does not have transportation to Makkah and back **2. Physical Inability:** - Very old (shaykh kabir) - Sick and unable to ride or bear travel hardship **3. Unsafe Path:** - Highway robbers - Epidemic or plague - Anything that threatens life or property **For Women - Additional Condition:** - Must have a mahram (male relative) to accompany her - **Hadith:** "It is not permissible for a woman who believes in Allah and the Last Day to travel for three days or more except with her father, son, husband, brother, or mahram" [Muslim] - **Hadith:** A man said his wife was going for Hajj and he enlisted for a military expedition. The Prophet ﷺ said: "Go and perform Hajj with your wife" [Bukhari & Muslim] **If She Performs Hajj Without Mahram:** - Hajj is valid - But she is sinful
