Crimes against body, limbs and functions
**Definition:** Crime against less than life is every harm inflicted on a person that does not lead to death - such as wounds, cutting limbs, and the like. **Evidence for Qisas in Less Than Life:** **From the Quran:** Allah says: "And We ordained for them therein a life for a life, an eye for an eye, a nose for a nose, an ear for an ear, a tooth for a tooth, and for wounds is legal retribution" [Al-Ma'idah: 45]. **From the Sunnah:** The Prophet ﷺ said in the story of Ar-Rubayyi' who broke a girl's tooth: "The Book of Allah [decrees] retribution" [Bukhari & Muslim]. **Consensus:** Scholars have unanimously agreed on the obligation of Qisas in less than life, when possible. --- **Three Types:** 1. **Crime by wounding** (الجناية بالجرح) 2. **Cutting a limb** (قطع طرف) 3. **Disabling a function** (إبطال منفعة عضو)
