Intentional, quasi-intentional, and accidental
**Cutting a limb is of three types:** 1. **Intentional** (عمد) 2. **Quasi-intentional** (شبه عمد) 3. **Accidental** (خطأ) **Qisas is NOT obligatory in accidental or quasi-intentional** - only in intentional, like with killing. --- **Three Conditions for Qisas in Limb-Cutting:** **1. Possibility of Equal Retaliation Without Excess (الاستيفاء بلا حَيْف):** The cut must be from a joint or have a defined limit - like fingertips (أنامل), wrist (كوع), elbow (مرفق). - NO Qisas in wounds that have no defined end (like Ja'ifah) - NO Qisas in breaking bones other than teeth - like thigh, forearm, or shin bones --- **2. Equivalence in Name and Position (التماثل في الاسم والموضع):** Between the perpetrator's limb and the victim's limb. - Right is not taken for left - Pinky finger is not taken for ring finger - Original limb is not taken for an extra one --- **3. Both Limbs Must be Equal in Health and Completeness (الاستواء في الصحة والكمال):** The limbs of perpetrator and victim must be equal. - A healthy limb is not taken for a paralyzed one - A complete hand (with all fingers) is not taken for an incomplete one - And so on...
