Disabling a Function

**Ruling:** If the perpetrator disables a function of the victim's limb, there is NO Qisas - because equal retaliation cannot be guaranteed without excess. **Diyah:** Full Diyah (of a complete person) is obligatory. --- **Partial Loss:** If only part of the function is lost: - If the amount lost can be determined: he receives that proportion of the Diyah (e.g., half Diyah for half the function) - If the amount cannot be determined: Hukumah is required - assessed by the judge's ijtihad --- **Examples of Functions (المنافع):** - Removing the intellect (العقل) - Removing hearing (السمع) - Removing sight (البصر) - Disabling smell (الشم) - Losing speech and voice (النطق والصوت) - Losing taste (الذوق) - Losing ability to chew (المضغ) - Losing ability to ejaculate (الإمناء) - Disabling the ability to procreate (قوة الإحبال) - And other functions...
