Four rights before distribution
**Definition of Estate (التركة):** The estate is what the deceased leaves behind of cash, property, and rights. **Four Rights Related to the Estate:** **1. Funeral Expenses:** The cost of preparation - shroud, embalming, burial fees, washing, and such. **2. Settling Debts:** Debts to Allah take precedence (zakat, fitr charity, expiation, vows), then debts to people. **3. Executing Bequests:** Provided they are within one-third or less. **4. Inheritance:** What remains after the above is divided among heirs according to Sharia. **Inheritance (الإرث):** The transfer of the deceased's wealth to the living according to the Book of Allah and the Sunnah of His Messenger ﷺ. **Note:** If there are property rights attached during the deceased's life - like the seller's right to the sold item or the pledgor's right to the pledge - these take precedence over funeral expenses, as they attached to the specific property before it became estate.
