The Six Fixed Shares

The total number of those with fixed shares is **21**. The six fixed shares are: Half, Quarter, Eighth, Two-thirds, Third, Sixth. --- **1. OWNERS OF HALF (5 people):** **a) Husband:** When there is no inheriting descendant (male or female) from him or from others. **b) Daughter:** When alone - no sisters sharing, no brothers making her residuary. **c) Son's Daughter:** When there is no sharer, no residuary maker, and no inheriting descendant. **d) Full Sister:** When there is no residuary maker, no sharer, no inheriting descendant, and no inheriting ancestor. **e) Paternal Sister:** Same conditions as full sister, plus no full brother or full sister. --- **2. OWNERS OF QUARTER (2 people):** **a) Husband:** When there is an inheriting descendant. **b) Wife:** When there is no inheriting descendant. --- **3. OWNERS OF EIGHTH:** Wife (or wives) when there is an inheriting descendant. --- **4. OWNERS OF TWO-THIRDS (4 groups):** **a) Daughters:** When there is no residuary maker (son), and they are two or more. **b) Son's Daughters:** When there is no residuary maker (son's son), no inheriting descendant (son), and they are two or more. **c) Full Sisters:** When they are two or more, with no residuary maker (full brother), no inheriting descendant, and no inheriting ancestor. **d) Paternal Sisters:** Same conditions, plus no full sibling. --- **5. OWNERS OF THIRD (2 people):** **a) Mother:** When there is no inheriting descendant, and no plurality of siblings. **b) Maternal Siblings:** When they are two or more, with no inheriting descendant and no inheriting male ancestor (father or grandfather). --- **6. OWNERS OF SIXTH (7 people):** **a) Father:** When there is an inheriting descendant. **b) Grandfather:** When there is an inheriting descendant. **c) Mother:** When there is an inheriting descendant, or when there is a plurality of siblings. **d) Grandmother:** When there is no mother. **e) Son's Daughter:** When there is no residuary maker, no higher inheriting descendant - except with a daughter who takes half (she then takes one-sixth to complete two-thirds). **f) Paternal Sister:** Same conditions as son's daughter - when with a full sister who takes half. **g) Maternal Sibling (one):** When there is no inheriting descendant, no male inheriting ancestor, and they are alone.
