Abu Bakr said: 'If they withheld even a baby goat they used to give, I would fight them'
Status of one who withholds out of stinginess
**Status:** - Sinful but NOT a disbeliever - Zakat is a branch of religion; not giving it doesn't remove one from Islam **Evidence:** - Prophet ﷺ said about Zakat withholder: "Then he will see his path—either to Paradise or to Hell" [Muslim] - If he were a disbeliever, he would have no path to Paradise **Consequences:** 1. Zakat taken from him by force 2. He is disciplined/punished (ta'zir) 3. If he fights to prevent it, he is fought until he submits **Evidence:** - "If they repent, establish prayer, and give Zakat, let them go" [9:5] - "I was commanded to fight people until they testify...establish prayer, and give Zakat" [Bukhari & Muslim] - Abu Bakr: "If they withheld a baby goat (anaq) they used to give the Prophet ﷺ, I would fight them for it" [Bukhari & Muslim] The Companions unanimously agreed on fighting Zakat withholders.
