**Condition:** The contracted item must be capable of being delivered. **Reasoning:** - What cannot be delivered is like something non-existent - Its sale is not valid - It falls under the sale of gharar (uncertainty) - The buyer might pay the price and not obtain the item **Prohibited Sales:** - Fish in the water - Dates inside their pits - Birds in the air - Milk in the udder - The fetus in its mother's womb - Runaway animals **Evidence:** - **Hadith of Abu Hurayrah رضي الله عنه:** "The Messenger of Allah ﷺ forbade the sale of gharar" [Muslim]
